Private Citizen and Journalist Richard Dela Sky has invoked the interpretative and enforcement jurisdiction of the nation’s apex Court over what he described as “divisive matter of the purported rejection on November 26, 2021 and the purported subsequent approval of the 2022 Budget Statement and Economic Policy of the Government of Ghana on December 30, 2021 through questionable Parliamentary processes”.

In a statement released on his official Facebook on Wednesday December 1, 2021, the ace broadcaster wrote “On the consolidated force of the foregoing provisions I have – as a citizen of Ghana – instructed my lawyers, and caused to be filed at the Supreme Court of Ghana two separate writs within the last 48 hours”.  

Mr. Sky continued that “Like many other citizens of Ghana, I strongly believe that the questionable processes used to purportedly reject and the subsequent purported approval 2022 Budget Statement and Economic Policy of the Government of Ghana have done various forms of substantial violence to cardinal provisions of the Constitution 1992 of the Republic of Ghana”.

He intimated that a sin by any person, institution or organ of state against the 1992 Constitution of the Republic of Ghana constitutes a grievous violation of the collective will Ghanaians which he said imposes an obligation on those who care about the spirit and letter of the constitution, constitutionalism and the rule of law to pray to the learned and distinguished Justices of our Supreme Court to intervene “and exercise their exclusive authority in a manner that restores the sanctity of our Constitution”.  

There may be times when a government and or the organs of state will fail our nation, but at all times citizens must be vigilant to advance our governance in good conscience and a sense of honest conviction, the statement concluded.

Accra, 1 December 2021

Clause 1 of Article 1 of the Constitution 1992 of the Republic of Ghana states:

“1. The Sovereignty of Ghana resides in the people of Ghana in whose name and for whose welfare the powers of government are to be exercised in the manner and within the limits laid down in this Constitution” (emphasis mine).

The Constitution 1992 of the Republic of Ghana then proceeds to provide under Clause 1 (b) of Article 2 that “a person who alleges that any act or omission of any person, is inconsistent with, or is in contravention of a provision of this Constitution, may bring an action in the Supreme Court for a declaration to that effect” (emphasis mine).

On the consolidated force of the foregoing provisions I have – as a citizen of Ghana – instructed my lawyers, and caused to be filed at the Supreme Court of Ghana two separate writs within the last 48 hours, invoking the interpretative and enforcement jurisdiction of the nation’s apex Court over the divisive matter of the purported rejection on 26th November 2021 and the purported subsequent approval of the 2022 Budget Statement and Economic Policy of the Government of Ghana on 30th December 2021 through questionable Parliamentary processes.

Like many other citizens of Ghana, I strongly believe that the questionable processes used to purportedly reject and the subsequent purported approval 2022 Budget Statement and Economic Policy of the Government of Ghana have done various forms of substantial violence to cardinal provisions of the Constitution 1992 of the Republic of Ghana.

The two writs, filed separately in the last 48 hours, are in unwavering defence of our constitution, constitutionalism and the rule of law.

I believe firmly that a sin by any person, institution or organ of state against the Constitution 1992 of the Republic of Ghana constitutes a grievous violation of the collective will of the good people of Ghana and, therefore, imposes an obligation on those who care about the spirit and letter of the constitution, constitutionalism and the rule of law to pray to the learned and distinguished Justices of our Supreme Court to intervene and exercise their exclusive authority in a manner that restores the sanctity of our Constitution.
