The Accra High Court’s Human Rights Division may have performed its constitutional right to order Achimota School to admit the two Rastafarian students, but for the President of National Association of Graduate Teachers (NAGRAT) Angel Carbonu the ruling could only mean that students can now freely wear anything to school regardless of the prevailing rules and regulations.

Tyron Iras Marhguy and Oheneba Kwaku Nkrabea filed a lawsuit against Achimota School’s board of governors, the Minister of Education, the Ghana Education Service, and the Attorney General in order to have their fundamental human rights enforced.

The applicants asked the court to “declare that the 1st Respondent’s (Achimota School Board of Governors) failure and or refusal to admit or enroll the Applicant on the basis of his Rastafarian religious inclination, beliefs, and culture characterized by his keeping of Rasta is a violation of his fundamental human rights and freedoms guaranteed under the 1992 constitution, particularly Articles 57 and 58“.

The Human Rights Division of the High Court, presided over by Justice Gifty Agyei Addo, held that the laws in question cannot impair the fundamental human rights of two, Tyron Iras Marhguy and Oheneba Kwaku Nkrabea , thereby ordering the 1st respondent to admit them

Meanwhile, Commenting few hours after the court ruling, the NAGRAT President said the decision of the court could mean only one thing, freedom for students to act and dress anyhow they want to school with no questions asked. For him, the ruling will not have any consequences on his union members or any other teacher, than to say it will be waste of time and energy now in trying to trains students, “I mean we don’t care”.

We don’t care whether it opens the Pandora box or not, we don’t really care. We will go to school and teach our Mathematics, English and Geography. We thank the court for making our work very easy. Students can now do whatever they want to do, somebody can choose to wear hat so that they would be protected from the sun shine, and we really don’t care about that” Mr. Carbonu said in an interview monitored by Mynewsafric.

Asked if he is not worried, he emphatically said ‘NO’ with explanation that he will be surprised any member of his union or any teacher will be surprised, saying there is a court ruling and that must be strictly obeyed.

He said personally as a parent, “with this ruling, I will look for schools that can build and reform my child, if I have the means to pay, I will do that for my child to be trained so that the training of the child will be what I want but If I don’t have the mean, then I will make do of what I have”.

We hitherto this ruling believe students should appear in school in some conformed manner, obey rule and regulations, establish an atmosphere conducive for teaching and learning, mindful of the fact that different children come from different homes with different upbringing, different characters and attitudes and there shall be rules and regulations that commonalize behavior so that teaching and learning can go on at the most critical stage of their lives so that when they finish that level of their life, and go to tertiary because they are more matured they can do what they like, I mean who chases anybody to go to bed or dress in particular way“, the NAGRAT President quizzed in bewilderment.
